Privacy Policy

Draft, not yet legal advice. This policy is a working draft written to describe how the product behaves. It must be reviewed by a qualified lawyer before launch to ensure it meets the laws that apply to you and your customers (including GDPR and CCPA).

By Your Side (“we,” “us”) provides an AI assistant that answers and places phone calls on behalf of our customers. This policy explains what personal data we handle, why, and the choices you have. By using the service you agree to this policy.

Who controls your data

When you sign up and configure an assistant, you are the controller of the call data your assistant handles, and we act as your processor for that data. We are the controller of your own account information (such as your login email and billing details).

Information we collect

  • Account information: your name, email, password, and billing details.
  • Business knowledge you provide: the documents, FAQs, hours, pricing, and other content you give your assistant.
  • Call data: audio recordings, transcripts, summaries, caller phone numbers, call times and durations, and any messages or details a caller shares.
  • Usage data: logs, device information, and diagnostics needed to run and secure the service.

How we use it

  • To answer and place calls, and to perform the actions you've configured (booking, transfers, messages).
  • To create recordings, transcripts, and summaries and make them available to you.
  • To operate, secure, support, and improve the service.
  • To process payments and manage your subscription.

We do not sell your personal data, and we do not use your call content to train third-party AI models for unrelated purposes.

Call recording & consent

By Your Side records and transcribes calls so you have an accurate record. Laws on recording phone calls vary by country and region. Some require that all parties are notified or consent. You are responsible for ensuring calls are recorded lawfully where you and your callers are located, including providing any required notice. We provide tools to support this, but compliance is your responsibility.

AI processing & third parties

To deliver the service we use trusted infrastructure and AI providers, for example telephony carriers, speech-to-text, large-language-model, and text-to-speech providers, hosting, and payment processing. These providers process data only to perform services for us, under contractual safeguards. A current list is available on request.

Data retention

We keep call recordings, transcripts, and summaries for as long as your account is active so you can access them, and delete or anonymise them within a reasonable period after you delete them or close your account, unless we must retain them for legal reasons.

Your rights

Depending on where you live, you may have the right to access, correct, export, or delete your personal data, and to object to or restrict certain processing (GDPR), or to know about and opt out of certain data practices (CCPA). To exercise these rights, contact us at support@byourside.ai.

Security

We use encryption in transit, access controls, and other safeguards to protect your data. No system is perfectly secure, but we work to protect your information and to notify you of serious incidents as required by law.

International transfers

Your data may be processed in countries other than your own. Where required, we rely on appropriate safeguards (such as standard contractual clauses) for these transfers.

Changes

We may update this policy. We'll post the new version here and update the date above, and tell you about material changes.
