These Terms of Service (the “Terms”) govern your access to and use of By Your Side (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service for an organisation, you confirm you have authority to accept these Terms on its behalf.

The service

By Your Side is an AI assistant that answers and places phone calls on your behalf. It can book meetings, take messages, warm-transfer calls, and create recordings, transcripts and summaries. Features may change as we improve the product.

Your account

You are responsible for the information you provide, for keeping your login secure, and for all activity under your account. Tell us promptly if you believe your account has been compromised.

Acceptable use

You agree not to use the Service to:

break the law, or help anyone else do so;
make unsolicited, deceptive, or harassing calls;
impersonate another person or business without permission;
interfere with or attempt to disrupt the Service.

Call recording is your responsibility

The Service can record and transcribe calls. Laws on recording calls vary by country and region, and some require notice or consent from everyone on the call. You are responsible for using recording lawfully where you and your callers are located, including giving any required notice. See our Privacy Policy for how we handle this data.

Fees, trial & billing

Paid plans start with a 14-day free trial. After the trial, your plan renews automatically for the period you chose (monthly or annual) until you cancel. Prices are shown before you subscribe. Usage above your plan's limits may incur additional charges, which we will make clear in the app.

Cancellation & refunds

You can cancel anytime from your account. Your plan stays active until the end of the period you have already paid for, and we do not provide pro-rated refunds for partial periods unless the law requires it.

Availability & changes

We work hard to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may add, change, or remove features, and we will give reasonable notice of material changes where we can.

Limitation of liability

To the extent allowed by law, By Your Side is provided “as is,” and we are not liable for indirect, incidental, or consequential damages, or for lost profits, data, or business, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.

Termination

You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or use the Service in a way that risks harm to others or to the Service.

Changes to these Terms

We may update these Terms. We will post the new version here and update the date above, and tell you about material changes. Continuing to use the Service after a change means you accept it.
